I’m experiencing this issue and I’m on 1.9.6.1. I think my use case may be subtly different though.
I’m using a product archive template which displays all products for a specific composer. The composer is a product attribute. The URL:
When I use the infinite scroll and reach the end of Joshua Mohapeloa’s works, another composer’s works start appearing, i.e. it’s not respecting the attribute of the page.
My query:
It must be related to the new live query feature - when I turn that off, the infinite scroll works properly again. Would you like me to log another bug? I’ve already logged one relating to a similar issue with the live query feature.

I think I solved it. I set the query as the main query using the toggle and then it worked. You can mark this as closed.
